## Penalty basis — up to 4% of annual turnover
The UCPD (Directive 2005/29/EC), as amended by the Omnibus/Modernisation Directive (EU) 2019/2161,
requires Member States to provide for fines with a maximum of **at least 4% of the trader's annual
turnover** in the Member State(s) concerned for widespread infringements (or at least EUR 2 million
where turnover information is unavailable). ECGT (2024/825) adds greenwashing practices to the UCPD
Annex I blacklist, so these penalties attach to unsubstantiated environmental claims.

## Enforcement precedent — Shein / ISEL (France, 2025)
On **3 July 2025** France's **DGCCRF** imposed a **EUR 40 million** fine on **Infinite Style
E-Commerce Ltd (ISEL)**, operator of Shein, for deceptive commercial practices — including
**environmental claims it could not substantiate** (presenting itself as a "responsible company"
reducing its environmental impact by "reducing greenhouse gas emissions by 25%"), plus misleading
promotional pricing (57% of studied promotions showed no real reduction). A separate **EUR 1.098
million** fine was imposed for non-compliance with environmental-information obligations. The European
Commission had also found Shein in breach of EU consumer law in May 2025. Fine accepted via settlement.

## Timeliness — France anti-fast-fashion law
France's law against ultra-fast fashion was **definitively adopted on 29 June 2026** (Violland law):
environmental "malus" penalties on high-volume low-cost items, mandatory sustainability disclosures,
and a ban on advertising for ultra-fast-fashion (including influencer promotion) — explicitly aimed at
Shein, Temu and AliExpress. Note: the advertising-ban's conformity with EU law drew Commission
reservations, so its entry into force is not yet certain (context/hook, not a core compliance check).

## Recycled-content reality — Textile Exchange Materials Market Report 2025 (pub. Sep 2025)
- Recycled polyester was **12% of all polyester** produced in 2024 (down from 12.5% in 2023);
  volume rose 8.9 -> 9.3 million tonnes but share fell as virgin polyester grew faster.
- **~98%** of recycled polyester is made from **plastic bottles**, not textiles.
- **Textile-to-textile recycled fibre is <1%** of the total fibre market.
